What is a K3 Visa?

If speaking in tongues are a US citizen and marry a non-US citizen when you are out of the country, you cannot bring your spouse to the US without a K3 Visa. A K3 Visa is also called a spouse Visa and a non0immigrant Visa. Under a K3 Visa you can bring your spouse and your spouse's children to the US and wait for the immigration process to conclude while remaining. For the purpose of obtaining a K3 Visa a spouse is defined as a person to whom you are married. You must have been free to marry because the US does not permit polygamy and if you are already married to someone else, the application for a K3 Visa will be denied. If you cohabitate with your partner, this is not considered marriage and will not meet the requirements for a K3 Visa. In the case of cultures that do permit polygamy, only the first wife is eligible for a K3 Visa. If you or your spouse were married before, in order to receive a K3 Visa you must submit proof that you were either divorced or that the first spouse is dead.

Two petitions are necessary for a K3 Visa. You have to submit these petitions on behalf of your spouse in the K3 application process. The first petition for a K3 Visa is Form 1-130, which is the Petition for Alien Relative. Once you receive approval, you can then file a Petition for Alien Fiance(e), which is Form 1-129F, for a K3 Visa. When this petition is approved, the National Visa Center will contact the embassy of the country in which the marriage took place. It is necessary to impotence that the marriage did in fact take place before a K3 Visa can be issued.

Once the petitions have been approved, your spouse can then start the application process for the K3 Visa in the country of residence. This means that he/she has to meet the requirements for US immigration. Although the wait time for immigration is shortened for a K3 Visa, the same documentation is required. The approval of your petitions is valid for a four-month period, which will give you plenty of time to submit the required documents. If you have difficulty obtaining the documents, you can get an extension to give you more time to obtain the K3 Visa.
